By registering as a Grower, creating listings, or using any part of this service, you agree to the following Terms and Conditions.

1. About Earthborn.africa

Earthborn.africa (“we”, “us”, “the platform”) provides a free listing service that allows Growers to advertise homegrown produce, herbs, seeds, seedlings, remedies, and related items.

We are not:

• The seller.
• The manufacturer.
• The grower.
• The distributor.
• A quality or safety authority.

We do not guarantee the accuracy, safety, legality, or availability of any items listed by Growers.

2. Role & Responsibility of Growers

By registering as a Grower, you agree that:

1. You are solely responsible for:
   • The safety, quality, and accuracy of the produce you list.
   • Ensuring your listings are truthful and free of misleading claims.
   • Complying with all relevant food safety, agriculture, and local sale regulations.
   • Responding to enquiries from potential buyers.
   • Updating or removing listings when stock is unavailable.
2. You may only list items that you personally grow, make, or supply.
3. You must keep your email address up to date so that reminders and enquiries reach you.
4. You agree not to list:
   • Prohibited plants.
   • Illegal substances.
   • Harmful or dangerous items.
   • Mislabelled or falsely advertised items.
5. You confirm that your produce descriptions are accurate, including:
   • Whether items are “organic”
   • Quantities, sizes, and pricing
   • Any potential allergy or safety information (where relevant)

3. Role & Responsibility of Buyers

Buyers understand that:

• Earthborn.africa does not inspect or verify produce.
• All transactions are strictly between Buyer and Grower.
• Buyers must exercise personal judgement and due diligence.
• Buyers should store, clean, and prepare produce safely.
• For remedies or medicinal herbs, buyers are advised to consult a qualified health professional.

4. Liability Disclaimer

To the maximum extent permitted by law, Earthborn.africa cannot be held liable for any loss, damage, injury, illness, or dissatisfaction arising from:

• Consumption of produce.
• Use of medicinal herbs or remedies.
• Incorrect or misleading information provided by Growers.
• Allergic reactions.
• Unsafe preparation, transport, or storage of produce.
• Failed or incomplete transactions.
• Misrepresentation by Growers.
• Contamination, spoilage, or pests.
• Delivery problems or collection issues.
• Disputes between Growers and Buyers.

You agree to use the platform at your own risk.

5. Emails, Notifications & Consent

By registering as a Grower, you agree that the platform may send you:

• Enquiries from potential buyers.
• Weekly “still in stock?” reminders for your listings.
• Platform updates relevant to Growers.

You may request account deletion at any time by contacting us.

Growers may optionally consent to allow Earthborn.africa to share their listings and images on Earthborn’s social media pages for promotional purposes.

6. Content Ownership & Permission

By submitting text or images to Earthborn.africa, you:

• Confirm that the content belongs to you and does not infringe on any rights.
• Grant Earthborn.africa permission to display the content on the site.
• Grant optional permission (if you checked the consent box) for Earthborn.africa to share your listings on Facebook or other social platforms.

You retain all original ownership of your content.

7. Listing Expiry & Removal

All listings automatically expire after 28 days unless renewed or updated.

Earthborn.africa reserves the right to:

• Remove or hide listings that appear unsafe, inappropriate, or suspicious.
• Remove Growers who repeatedly fail to update listings or violate the rules.
• Decline listings that do not fit the purpose or values of the platform.

8. No Medical Advice

Some Growers may list herbs or remedies traditionally used for health purposes. Earthborn.africa:

• Does not provide medical advice.
• Does not guarantee any health benefits.
• Does not verify medical claims.
• Strongly recommends consulting a healthcare professional before using any herb or remedy for medicinal purposes.

9. Privacy & Data Protection

The platform stores Grower information such as:

• Name
• Email
• City/Suburb
• Produce listings
• Messages sent via the enquiry form
• Consent choices

This information is used only for the functioning of the Earthborn Growers Market.
We do not sell or share your personal details with third parties.

10. Amendments

Earthborn.africa may update these Terms & Conditions at any time. All Growers will be notified when significant changes are made. Continued use of the platform constitutes acceptance of updated terms.
